Please read these Terms carefully before using our Website or Services. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Website or our Services.

We reserve the right to modify these Terms at any time. All changes are effective immediately when posted on this page, with the “Last Updated” date reflecting the most recent revision. Your continued use of the Website following the posting of revised Terms means you accept and agree to the changes.

Services Description

3D Lighting provides professional holiday and decorative lighting design, installation, maintenance, and removal services for residential and commercial properties in the Dallas-Fort Worth area. Our specific Services include, but are not limited to:

  1. Consultation and custom lighting design
  2. Professional installation of lighting and decorations
  3. Maintenance throughout the display period
  4. Removal and optional storage of lighting equipment
  5. Sale of lighting products and accessories

User Representations

By using the Website, you represent and warrant that:

  1. You have the legal capacity to enter into these Terms
  2. You are at least 18 years of age
  3. You will use the Website in accordance with these Terms
  4. Your use of the Website does not violate any applicable law or regulation
  5. All information you provide to us is true, accurate, current, and complete

Quotes and Pricing

  1. All quotes provided through our Website or during consultations are estimates only and subject to change upon physical inspection of your property
  2. Quotes are valid for 30 days from issuance, unless otherwise specified
  3. Final pricing may be adjusted based on:
    • Property access or installation challenges not apparent during initial assessment
    • Changes to the scope of work requested by the client
    • Additional materials or labor required

Scheduling and Installation

  1. Installation dates are secured upon receipt of the required deposit
  2. Scheduling is subject to availability and weather conditions
  3. We require reasonable access to your property on the scheduled installation date
  4. Rescheduling requests must be made at least 48 hours in advance of your scheduled appointment
  5. Weather-related rescheduling will be handled at our discretion with no penalty to the client

Payment Terms

  1. A deposit of 50% of the total project cost is required to secure your installation date
  2. The remaining balance is due upon completion of installation
  3. We accept major credit cards, checks, and electronic payments
  4. Late payments may incur a fee of 1.5% per month on the outstanding balance
  5. Returned checks will incur a $35 processing fee

Cancellation Policy

  1. Cancellations made 14 or more days before your scheduled installation date will receive a full refund of your deposit
  2. Cancellations made between 7-13 days before your scheduled installation date will receive a 50% refund of your deposit
  3. Cancellations made less than 7 days before your scheduled installation date will forfeit the deposit
  4. 3D Lighting reserves the right to cancel service due to unsafe conditions, including but not limited to severe weather

Equipment and Materials

  1. All lighting equipment and materials provided by 3D Lighting remain our property unless specifically purchased by the client
  2. Clients are responsible for reasonable care of installed equipment while on their property
  3. Damage to equipment due to client negligence may result in additional charges
  4. Theft or vandalism of installed equipment should be reported immediately

Property Access and Preparation

  1. Clients are responsible for providing safe access to installation areas
  2. Electrical outlets must be functional and accessible
  3. Clients must notify us of any property features that may affect installation
  4. We are not responsible for damage to improperly installed or damaged existing fixtures

Intellectual Property

  1. All content, features, and functionality of the Website, including but not limited to text, graphics, logos, and images, are owned by 3D Lighting and are protected by copyright, trademark, and other intellectual property laws
  2. Photos of completed installations may be used by 3D Lighting for marketing purposes unless client specifically opts out in writing

Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, 3D LIGHTS PRO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR OUR SERVICES.

OUR TOTAL LIABILITY FOR ALL CLAIMS IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE WEBSITE WILL NOT EXCEED THE AMOUNT PAID BY YOU TO 3D LIGHTING IN THE LAST THREE (3) MONTHS.

Indemnification

You agree to defend, indemnify, and hold harmless 3D Lighting, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Website.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to any principles of conflicts of law. Any legal suit, action, or proceeding arising out of or related to these Terms or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Texas, in each case located in Dallas County.

Dispute Resolution

Any dispute arising from these Terms or your use of the Website shall be resolved through good faith negotiations between the parties. If such negotiations fail, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, with arbitration to take place in Dallas, Texas.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

No waiver by 3D Lighting of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
